Can First Amendment freedoms of speech and the press be limited during a time of civil war?
THE CASE
The United States has been fighting a bloody civil war for three years. The Confederacy is attempting to break away from President Abraham Lincoln and the Union. In the North, people are divided over whether the war is justified and worth fighting. Many Northern Democrats sympathize with the Confederacy and want to seek peace with them. In July 1863, deadly riots break out in New York City and other Northern towns over the start of a military draft, which forces selected citizens to enlist in the military and fight in the war.
A new crisis strikes on May 18, 1864. At 3:30 a.m., a messenger pretending to be from the Associated Press news service delivers a forged presidential proclamation to a number of New York City newspapers. The proclamation calls for 400,000 more troops through either voluntary enlistment or a new draft. It makes the Union Army seem desperate. Most papers check on the validity of the proclamation and don’t print it. But two newspapers, the World and the Journal of Commerce, print the fake proclamation in their morning editions. Both of these newspapers have a history of criticizing the Lincoln administration and were blamed by Republicans (Lincoln’s party) for starting the 1863 Draft Riots by publishing anti-war editorials.
Government and military officials are alarmed by this fake proclamation, fearing it could provoke unrest. Secretary of War Edwin Stanton orders an Army general to shut down both newspapers and arrest their editors. President Lincoln signs off on the action.
QUESTIONS TO CONSIDER
Why did the World and the Journal of Commerce print the proclamation? Do you think it was on purpose or an accident?
What type of problems did the government and army officials think the proclamation might cause? Why?
Beyond closing down these two newspapers, what effects might Lincoln’s order have on public opinion and support for the war?

Position: Freedom of press is important, but the Constitution allows for the president to restrict our rights during a time of rebellion whenever their exercise endangers the Union and the war effort.

This is a Journal Entry I do not need a cover page This has to be 2 complete pages For Immanuel Kant, the fundamental question isn’t “What is the right thing to do?” or “Who is the right person to be?” or “What will create the most happiness?” For Kant, the fundamental question is “Can this action be made a consistent universal law?” A part of his moral philosophy that is often understated is that he spoke for broad moral laws, not a bunch of exceptions; for example, he would say that lying cannot be made a consistent universal law, and exceptions like not hurting people’s feelings or to keep a party a surprise would not be acceptable. Kant also said that part of living in a moral society is helping others live morally without forcing or coercing them. This is a consistent universal law and a human duty. So is upholding human dignity. So is not causing unnecessary pain (which he extended to not causing unnecessary pain to animals). And plenty more. Kant also stated that we should use people only as ends unto themselves (upholding their dignity), not as means to our own ends. ———————————- Without doing any research on Kant’s social views or what philosophers have said, pick one of the following issues and explain whether or not it could consistently be made a universal law. For this entry:
Interview two people with differing views regarding whether Medical and/or Recreational Cannabis should be legalized in states and/or federally.
Your interview should include at least 8 questions directed at the interviewee. At least 5 of these questions should be identical across both interviews, other questions can differ for your “pro” interview” and your “con” interview. At a MINIMUM, please include the following information gleaned from your interviews:
1.) Does the interviewee have differing opinions regarding the legalization of medical versus recreational Cannabis?
2.) Does the interviewee have differing opinions regarding legalization at the state versus the federal level?
3.) What personal experiences if any does the interviewee report as having contributed to his/her opinions?
4.) How knowledgeable does the interviewee believe they are in certain aspects of recreational and/or medical cannabis (examples of aspects to consider: what is cannabis? What are its effects? What are THC and CBD? How addictive is cannabis? What has been the impact of legalization of medical or recreational cannabis in states regarding crime, income, opioid use, etc)
